Interstate Music Awards - Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. LIMIT ONE (1) ENTRY PER PERSON.

I. Eligibility

The Contest is open to all legal residents of the United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. Employees of Interstate Music and other companies associated with the promotion of the Contest, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee, are not eligible to participate in the Contest.

II. Sponsor

The Contest is sponsored by Interstate Music, located at 1501 E. Wisconsin Street, Delevan, Wisconsin 53115.

III. Agreement to Official Rules

Participation in the Contest constitutes Your full and unconditional agreement to, and acceptance of, these Official Rules and the decisions of Interstate Music, which are final and binding. To remain eligible to win a prize, You must comply with these Official Rules and fulfill all other requirements as set forth herein. If You fail to comply with these Official Rules, your eligibility to win a prize may be revoked at the sole discretion of Interstate Music.

By entering the Contest, You hereby grant Interstate Music and any of Interstate Music’s clients or designees the right to use Your name, city of residence and any image taken of You by, or on behalf of, Interstate Music, in connection with the Contest, in any and all media now or hereafter devised without limitation and without additional compensation, notification, permission or other liability to You or Your heirs, executors, administrators, personal representatives or assigns.

IV. How to Enter

Subject to Your compliance with these Official Rules, You may enter the Contest online at https://interstatemusicawards.com. In order to ensure that Your entry is accepted, please follow all directions provided, fill out all requested information, and submit.

V. Limitations on Entry

The Contest is limited to one (1) entry per person, per email address, and per household for the duration of the Contest Entry Period. Entries received from any person, e-mail address, or household in excess of the stated limitation are void, and such entrants will not be eligible to participate in the Contest. You acknowledge that all entries become the property of Interstate Music and will not be acknowledged or returned to You.

VI. Contest Entry Period

The Contest begins on August 3, 2021 at 4:00PM CDT and ends on February 28, 2022 at 11:59PM CDT (the “Contest Entry Period”). Entries that are submitted before or after the Contest Entry Period are disqualified and will not be considered.

VII. Nominee Selection, Voting, and Determination of Winners

Between March 1, 2022 and March 31, 2022, judges featured on our website (https://interstatemusicawards.com/about/) will review all valid entries and select five (5) nominees for each award category.

Between April 4, 2022 and April 30, 2022, voting will open to the public. The winner of each individual award category will be determined based on popular vote. In the event of a tie, Interstate Music, in its sole discretion, may determine the method through which the tie may be resolved.

VIII. Winner Notification and Requirements

Interstate Music will attempt to notify the potential winner of each award category via telephone or email on or before May 7, 2022. Each potential winner, or a parent/legal guardian thereof (if a minor in his/her state of residence), will be required to complete, electronically sign, and submit a Winner’s Declaration and Release Agreement within five (5) days of either: (i) the date which the potential winner is contacted by Interstate Music, or (ii) the date which attempted notice is sent to the potential winner by Interstate Music. Interstate Music reserves all rights to select an alternate winner based on the next most popular vote in that respective award category if Interstate Music is unable to reach the potential winner within five (5) days, if a potential winner fails to submit the Winners Declaration and Release Agreement, or if a potential prize is returned as undeliverable.

If the potential winner is at least eighteen (18) years old but is still considered a minor in his/her jurisdiction of residence, Interstate Music reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Winner’s Declaration and Release Agreement on the potential winner’s behalf, and fulfill any other requirements imposed on the winner as set forth herein. Even after being notified by Interstate Music as a potential winner, all potential winners must continue to comply with all terms and conditions of these Official Rules or risk disqualification. If a potential winner is disqualified for any reason, including at the sole discretion of Interstate Music, Interstate Music will award the applicable prize to an alternate winner as explained above. All prizes will be fulfilled approximately 8–10 weeks after the conclusion of the Contest, subject to unforeseeable delays.

IX. Prizes

All prizes for each award category may be found on the Interstate Music Website at the following links: (https://interstatemusicawards.com/awards/) or (https://interstatemusicawards.com/recognition-awards/). The prizes for the Contest may be updated or changed at any time by Interstate Music, and in the event such prizes become unavailable for any reason, Interstate Music will employ reasonable efforts to procure replacement or comparable prizes.

X. Impairment or Suspension of Contest; Disqualification

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to, fraud, viruses, unauthorized human intervention or other technical problems, or in the event the Contest is unable to run as planned for any other reason, as determined by Interstate Music in its sole discretion, Interstate Music may either: (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules; or (b) terminate the Contest entirely.

Interstate Music reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and/or a violation of the Terms of Service of the Interstate Music website, and should such an attempt be made, Interstate Music reserves the right to seek damages (including attorneys’ fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by Interstate Music to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

XI. Indemnification, Release, and Limitations of Liability

By participating in the Contest, You agree to indemnify, release, and hold harmless Interstate Music, and each of its respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including but not limited to lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, technical malfunctions, or other failures and difficulties; (b) unauthorized intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) incorrect application downloads; (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winners, the cancellation or postponement of the event, if applicable, the processing of entries, or errors in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from Your participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). You further agree that in any cause of action, the Released Parties liability shall be limited to Your cost of entering and participating in the Contest, and in no event shall You be entitled to receive attorneys’ fees or any other damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages, which You hereby waive. The Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest.

XII. Disputes and Governing Law

Except where prohibited, You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by an appropriate court of competent jurisdiction located in the state of Wisconsin. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Your rights and obligations, or the rights and obligations of Interstate Music in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state of Wisconsin, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Wisconsin.

XIII. Privacy and Terms of Service

By entering the Contest, You hereby represent that you have read and agree to the Interstate Music Privacy Policy at https://im.interstatemusic.com/privacy-policy/, the terms of which are incorporated herein, and agree that the terms of such policy are reasonable. All information collected from You in connection with the Contest is subject to the Interstate Music Privacy Policy. In addition, by accessing the Interstate Music website at InterstateMusic.com, and any related sites, you hereby accept and agree to abide by the Terms of Service located at https://im.interstatemusic.com/terms-of-use/, which are hereby incorporated herein, which may supplement various aspects of these Official Rules.

XIV. Assignment

You may not assign, license, convey, subcontract or delegate your rights, duties or obligations hereunder these Official Rules.

XV. Headings

The section headings used herein are for convenience of reference only and do not form a part of these Official Rules, and no construction or inference shall be derived therefrom.

XVI. Severability

These Official Rules shall be deemed severable. If any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions. To the extent the term, clause or provision may be modified slightly to avoid being deemed invalid or unenforceable to effectuate the original intent of the Interstate Music and You (e.g., via blue penciling, etc.), You hereby agree to request such modification.

XVII. Entire Agreement

These Official Rules, together with all terms incorporated herein or referred to herein constitute the entire agreement between You and Interstate Music relating to the Contest, and supersedes any prior understandings or agreements (whether oral or written) regarding the subject matter of the Contest.
